Notarials

The Philippine Consulate General in Los Angeles can notarize documents signed by individuals that will be used in the Philippines. Personal appearance of the signatory/ies is a requirement for consular notarization.

Examples of documents that may be notarized by the Consulate General include:

  • Special Power of Attorney
  • General Power of Attorney
  • Deed of Donation
  • Deed of Absolute Sale
  • Contract to Sell
  • Extrajudicial Settlement
  • Bank Forms
  • Insurance Forms
  • Affidavits

Notarial services provided by the Consulate General do not include the drafting or preparation of legal documents. It is the responsibility of the party availing of the notarization services to prepare their own document. The personnel of the Consulate General also cannot act as witnesses in the document submitted for notarization.

Reminders:

  • All clients are required to make a prior appointment through our website.
    Appointment slots open every Monday at 5:00 p.m. onwards.
  • Clients need to bring the original and photocopy of documents for notarization, along with a valid passport or government-issued identification card. Each original document to be notarized must be accompanied by a photocopy the valid passport/ID.
  • Personal appearance of the signatory/ies is required. The person availing of notarial services should appear before a consular officer to sign the document for notarization.
  • The name and signature in the document to be notarized must be consistent with the information shown in the valid passport/ID
  • Processing fee:
    For each document to be notarized – US $25.00
    Expedite* processing fee – additional US $10.00
    (*for release the same day/following day)
  • Clients who prefer the document to be released through courier service must bring their own self-addressed prepaid stamped USPS Priority mail envelope.

PROCEDURES:

  1. Set up an appointment through the website.
  2. Proceed to the Consulate General on the appointment date and time
  3. Present and sign the document in front of the Consular Office along with the submission of the valid passport/ID
  4. Proceed to cashier for payment.

NBI CLEARANCE

The Consulate General can notarize the NBI fingerprint card form, which is the required document to apply for an NBI clearance.

EXTRATERRITORIAL SERVICE OF DOCUMENTS (SUMMONS, COURT ORDERS, DEPOSITIONS, ETC) FROM PH

  1. For legal documents ordered by a Philippine Court to be served within the Consulate’s jurisdiction:

     1. Coordinate with the Philippine Department of Foreign Affairs (DFA) –
        Office of Treaties and Legal Affairs (OTLA) on the submission of the
         following:
              a. Court order directing the DFA to undertake the extraterritorial service
                 of documents, with the complete name and address of the person upon
                 whom service is to be made (the more precise, the better)
             
    b. Court certified copry of documents to be served
              c. Relevant annexes

  2. For Depositions Upon Written Interrogatories within the Consulate’s jurisdiction:

        1. Coordinate with the Philippine Department of Foreign Affairs (DFA)
            Office of Treaties and Legal Affairs (OTLA) on the submission of the
            following:
                  a. Court order directing the DFA to serve the relevant court order and
                      written interrogatories, with the complete address of the
                      deponent (the more, the better)
                   b. Court certified copy of the court order and written interrogatories.

         2. Upon receipt of the required documents, DFA-OTLA will transmit the
             same to the Consulate General.

         3. Once the documents are recieved from the DFA, the Consulate General
             will mail to the deponent the deposition schedule and documents.

         4. On the scheduled date of dposition, deponent must personally appear
             before the Consular Officer with valid identification and the documents.

  • ONLY DOCUMENTS SENT BY THE PHILIPPINES’ DEPARTMENT OF FOREIGN AFFAIRS (DFA) WILL BE PROCESSED BY THE CONSULATE GENERAL
  • DO NOT DIRECTLY MAIL TO THE CONSULATE GENERAL THE COURT ORDER AND DOCUMENTS.

VIDEO CONFERENCING HEARINGS (VCH)


See the Revised Interim Guidelines on the Conduct of Videoconferencing Hearings (VCH) at the Consulate General.

Pursuant to applicable Rules and Regulations issued by the Supreme Court and the Department of Foreign Affairs, persons ordered by a Philippine Trial Court to appear before it through videoconference hearing (VCH) may be allowed to participate or testify via VCH at the Consulate General’s premises subject to the following conditions:

  1. Submission of a formal request letter addressed to the Consul General at least one (1) month prior to the scheduled court hearing, attaching a copy of the Court Order and Court Calendar;
  2. In view of the time difference between the Philippines and Los Angeles, VHC at the consulate is conducted only between 4:00-6:00 p.m. (Pacific Standard Time) or 5:00-7:00 p.m. (Pacific Daylight Time.) The requesting party must ensure that the case shall be FIRST in the Court Calendar. Should it appear that the testimony will go beyond 6:00 p.m. (PST) / 7:00 p.m. (PDT), the counsel for the testifying witness shall mover for continuance.
  3. Payment of the following fees per session:
    Use of facility –  US $432.00 [@ US $ 12.00/sqm (venue is 36sqm])
    Certification –             40.00
    Expedite Fee –           10.00
  4. The witness must be ath the Consulate General’s premised one hour before the scheduled hearing.
  5. The witness shall observe proper decorum at all times and shall wear office-appropriate attire while inside the Consulate General premises. The Consulate General reserves the right to terminate the VCH should the witness manifest rude behavior at any time before or during the proceedings.

The role of the Consulate General in a VCH is merely to provide the venue and internet connection. The witness shall bring his/her own laptop and secure the log-in link and credentials for the videoconferencing platform to be used before the scheduled VCH. In the event of technical difficulties and emergencies, whether on the part of the concerned court or of the Consulate General, and/or an extension of the hearing beyond the prescribed schedule, the Consulate General shall terminate the conduct of VCH and advise the counsel of the witness to request the court for continuance.

The duty of the Consular Officer and/or other personnel overseeing the VCH shall be limited to identifying the witness’ identity through his/her valid ID.  They shall neither take notes, record the proceedings, nor draft responses for the witness or his/her representative. They shall also not perform any other act, including answering consular-related questions during the conduct of VCH, unless with prior authority from the Department of Foreign Affairs.
